Terms of service
The terms under which you use Danube CRM and Danube TMS: your account, plans and payment, your data, AI features, integrations and each party’s liability.
Last updated: 28 October 2026
Who we are and what these terms cover
These terms of service (the “Terms”) apply to the use of the Danube platform, meaning Danube CRM and Danube TMS, and of the websites danubecrm.com and danubetms.com. The platform is provided by Load Your Cargo BV, with its registered office at Kernenergiestraat 19/J10, Antwerp (Wilrijk), Belgium (“Danube”, “we”, “us”).
Danube is meant for businesses and professionals. When you create an account or use the platform on behalf of an organization, you confirm that you are entitled to accept these Terms on its behalf. If your organization has signed a separate contract with us, that contract prevails where it differs from these Terms.
Definitions
In these Terms:
- Platform: the Danube CRM and Danube TMS applications, including their AI features, integrations and related browser extensions.
- Customer (“you”): the company or organization that opens a Danube account and on whose behalf the platform is used.
- User: any person the Customer gives access to the platform, such as an employee or a contractor.
- Organization owner: the User who manages the Customer’s account in the platform and is responsible for it.
- Customer Data: all data entered, uploaded or imported into the platform by the Customer or its Users, including emails, documents and files.
- Plan: the set of features and limits the Customer chooses, free or paid, as described on the pricing page and in the app.
- AI credits: the unit in which use of the AI features is measured.
Your account
To use the platform, your organization needs an account:
- The account is activated once you confirm your email address through the link we send you. Some accounts, such as Danube TMS accounts, are set up by our team.
- The details given at sign-up and for billing must be accurate, complete and up to date.
- Each User keeps their sign-in details safe, does not share them with anyone, and tells us straight away if they suspect unauthorized access. We recommend turning on two-factor authentication (2FA).
- Each organization has a single Owner, who is responsible for the account, for the Users they invite and for the activity in the organization’s account.
Plans and the free plan
The features, limits (such as the number of users, boards, items or automations) and prices of each Plan are those shown on the pricing page and in the app at the time.
The free plan has no time limit, but it has the usage limits shown on the pricing page and does not include AI features. When you reach a limit, some actions (such as adding new items) may be blocked until you move to a paid plan or reduce your usage.
Paid subscriptions, billing and payment
Paid plans are per-user subscriptions:
- Billing: monthly or yearly, as you choose, in advance for each period. The subscription renews automatically at the end of each period until you cancel it.
- Payment: by card through Stripe, where that option is available, or against the invoice we send you.
- Invoices: we issue an invoice for every payment and make it available in the app or by email.
- Price changes: we tell you by email or in the app at least 30 days in advance. The new price applies from the first billing period that starts after that notice.
- Refunds: we do not refund partly used periods (for example when you cancel, or reduce the number of users during a period), except where the law requires it. Cancellation takes effect at the end of the period already paid for.
Acceptable use
When using Danube, you and your Users must not:
- send spam or unsolicited commercial messages through the platform’s email tools (mass mail, sequences, automated messages);
- upload, store or send illegal content, content that infringes the rights of others, or malicious software;
- try to access other customers’ data, accounts that are not yours or parts of the platform you have no access to, or get around security measures;
- overload the platform or get around the usage limits (rate limits) we apply, including for automated access.
Your data
Customer Data belongs to the Customer. We use it only to provide the platform and the features you ask for, and we do not sell it.
For Customer Data, the Customer is the controller and we are the processor: we process it only on your instructions, in line with the Privacy policy and the data processing agreement (DPA, Article 28 GDPR).
- Export: you can export your data from the app at any time, for example any board to Excel.
- Deletion: at the Organization owner’s request, we delete the account and the Customer Data after a 30-day grace period, during which the request can be withdrawn and the data can still be exported. After that period the data is permanently deleted and cannot be recovered.
- Backups: deleted data is also removed from backups within a reasonable time, as those backups expire.
- Your responsibility: you are responsible for the lawfulness of the Customer Data and for the legal basis on which you process it in Danube.
AI features
Some Plans include features based on artificial intelligence, such as the AI assistant, document reading or drafting replies.
- AI-generated output may be incomplete or inaccurate. You review it before using it or passing it on; decisions based on it are yours.
- Use of AI features is measured in AI credits. Plans with AI include a monthly number of credits, and the app shows how many you have used.
- When you use an AI feature, the text it needs is sent to our AI provider only to produce the result. The details are on the AI page.
Third-party integrations
The platform can connect to third-party services, such as Google, Microsoft, ANAF e-Factura, SmartBill and Stripe.
- Use of these services is governed by their providers’ own terms and policies. We are not responsible for how they work, their availability or changes to them.
- You are responsible for the credentials, accounts and authorizations you use to connect them, and for being entitled to use them.
- Invoices sent through e-Factura are submitted on your behalf, with your digital certificate. You are responsible for the accuracy of the data in them.
Availability and support
We make reasonable efforts to keep the platform available and working correctly, but we do not guarantee uninterrupted or error-free operation.
From time to time we need maintenance windows. Where possible we schedule them outside business hours and announce planned work that may affect use of the platform in advance.
We provide support by email and through the channels shown in the app, during our business hours. We do not offer a service level agreement (SLA) unless one has been agreed in an Enterprise contract.
Suspension
We may suspend or restrict access to an account, fully or partly, in the situations below. Where possible we tell you first and give you time to fix the problem; where security requires it, we may act immediately.
- an invoice remains unpaid after its due date;
- the platform is used abusively or in breach of these Terms, in particular the acceptable use rules;
- suspension is needed to protect the security of the platform, of other customers or of their data.
Termination
You can stop using the platform at any time by cancelling your subscription and asking for your account to be deleted. A paid subscription stays active until the end of the period already paid for.
We may stop providing the service in case of serious or repeated breaches of these Terms, or if non-payment continues after suspension, with prior notice where possible.
After termination, Customer Data is handled as described under “Your data”: you can export it during the 30-day grace period, after which it is permanently deleted.
Warranties
The platform is provided “as is” and “as available”. To the extent permitted by law, we give no warranties other than those expressly set out in these Terms, including implied warranties of fitness for a particular purpose or of error-free operation.
Limitation of liability
To the extent permitted by law:
- our total liability for all claims relating to the platform or these Terms is limited to the amount the Customer paid us in the 12 months before the event giving rise to the claim;
- we are not liable for indirect damages, such as loss of profit, revenue, customers or data, or business interruption;
- these limits do not apply where the law does not allow liability to be limited, for example in cases of intent or gross negligence.
Changes to these terms
We may update these Terms. We publish the new version on this page and update the date at the top.
For material changes we notify you by email or in the app at least 30 days before they take effect. If you do not agree with them, you can stop using the platform before that date; if you keep using it, the changes are deemed accepted.
Governing law and jurisdiction
These Terms are governed by Romanian law. Any dispute that cannot be settled amicably is decided by the competent courts at the registered office of Load Your Cargo BV.
